Bilozyorov Y. National and International Law: Comparative Legal Dimension.

The article is devoted to the ratio of national and international law under the influence of globalization. In addition it describes the impact of globalization onto national legal systems of modern states, the main legal features, nature and origin of globalization. It also describes main directions of globalization studies. The particular attention is paid to the classification of globalization and its subspecies — legal globalization. The article emphasizes the special role of the new interdisciplinary field of knowledge — Globalistics — in the transformation period.

The main part of the article is devoted to the modernization of legal institutions of legal principles in the context of globalization. In particular, the article describes the ratio of national and international law in modern terms. It emphasizes the interaction of legal areas of economic and political spheres of society. It is revealed key directions of the Institute of Human Rights in the context of globalization and focused on the impact of globalization on human rights to both promotion the establishment of standards in globalization area and makes the emergence of new

threats to protected rights and interests of both the individual and society as a whole.

Also in the article the problems of legal enforcement of the principles of international law on national social relations. It is shown that the effectiveness of the principles of international law in national legal relations, in turn, depends on how fully and accurately reflected in the latest external patterns of international development with regard to internal features of national law. Effectiveness of the principles of international law on the national system depends on the effectiveness of the legal state, whereby the regulation of social relations. Undoubtedly, the implementation of these tools depends on the level of scientific development of the very principles of international law, how they perceived the legal practice of a country, as far as exhaust is a form, how they materialize in the real social relations. Principles of international law as regulators of social relations, with total commitment and determine the prospects of not only law but also society and the modern state in the context of globalization.

Legal principles are the measures of law and methodological basis for its further improvement, because it is based on the principles and assess the effectiveness of law in the real relationship.

Thus, the issue of scientific understanding of legal principles, its interaction is now up-to-date theoretical and practical importance: it focuses not only on historical, philosophical, moral and legal, but also on socio-political aspects of national lawyers.

Бобечко Н. Р. Провадження з перевірки судових рішень у проекті КПК України: здобутки і прорахунки.

У статті розглянуто регламентацію кримінально-процесуальної діяльності у Розділі V «Судове провадження з перегляду судових рішень» проекту КПК України. Аналізуючи відповідні положення проекту КПК України, автор подає своє бачення питань, що входять до предмета дослідження, висловлює пропозиції щодо вдосконалення законопроекту.

Бобечко Н. Р. Производство по пересмотру судебных решений за проектом УПК Украины: достижения и просчеты.

В статье рассмотрена регламентация уголовно-процессуальной деятельности в Разделе V «Судебное производство по пересмотру судебных решений» проекта УПК Украины. Анализируя соответствующие положения проекта УПК Украины, автор приводит свое видение вопросов, входящих в предмет исследования, высказывает предложения по усовершенствованию законопроекта.

Bobechko N. Proceeding on Revision of Judgements pursuant to the Draft of Criminal Procedure Code of Ukraine: Achievements and Looses.

The adoption of the new Draft Criminal Procedure Code of Ukraine (hereinafter — the DCPC) would represent the completion of long-term judicial reform in Ukraine. The draft Code of Ukraine has the extraordinary social and legal importance for codified legislation.

The aim of the article is to analyze the regulation of criminal procedure in Section V «The proceedings for revision of judgments» of DCPC. Unlike other stages of the proceedings and the applicable criminal procedural legislation of Ukraine, the analyzed part of the criminal procedure has not undergone such radical changes. Many provisions of current Criminal Procedure Code of Ukraine dated on 1960, like: the formulation of the grounds for reviewing judgments of the Cassation Court, the contents of the proceedings in the Supreme Court of Ukraine etc., or similar by content (for example, regulation of judicial appeal decisions, determination of individuals who may file an appeal, a statement of the normative content of the grounds for modification or cancellation the judgments in appeal, etc.).

DCPC took to model appeal as far as current Criminal Procedure Code of Ukraine in 1960 was mixed.

The authors of DCPC filled a number of so called «pure» cassation.

The novelty of the DCPC also gives to appeal or cassation court judge (the future Judge-Rapporteur) exclusive authority to verify the appellate and cassation appeal with the law for its content and form, setting the proper subject of appeal and cassation appeal, determining compliance with the terms to file an appeal and cassation, and establishing the admissibility of the facility and grounds for appeal and cassation review (Articles 398, 399, 428, 429 of DCPC).

The DCPC is the subject for transformation the pre-institute of criminal proceedings of the Court of Appeal which not only renamed the «preparation for appellate review» (p. 401), but ruled out such a task as the exercise of judicial control of legality and validity of the trial court acceptance of appeals decision and related issues.

The special features of the appeal proceedings at DCPC should include the ability to probe judgments and decisions of the trial court only after appeal (Part 1 of Art. 424).

The positive regulatory proceedings to review judicial decisions should include: firstly, the removal of provisions for determining the date of appeal and cassation; second, to install the same for the appeal and cassation court rules that define the scope of their review of the judgment. Third, formal consolidation rules about unacceptable deterioration of the situation of the accused under appeal (Article 421 CPC Project Ukraine). Fourth, the expansion of the grounds for review the judgments by new circumstances — «the establishment of the Constitutional Court

of Ukraine unconstitutionality by law, other legal acts or their separate provisions applied by the court» (p.5 Part 2 of Art. 459 DCPC).

In the conceptual issues the authors of DCPC did not change the procedure of conducting court decisions. The authors of DCPC did not add anything new to the procedure of reviewing the judicial decisions and the criteria of court decisions lawfulness, and in some cases led them to a level which is very far from perfect.

Ващенко А. Г. Кримінальна відповідальність батьків за доведення до самогубства власної неповнолітньої дитини.

У статті розглядаються проблеми відповідальності батьків за діяння, передбачене ст. 120 КК України, вчинене відносно власних дітей. Зокрема, пропонується доповнити ст. 120 КК України окремою частиною, яка передбачатиме відповідальність за таке діяння, вчинене щодо неповнолітнього, батьків чи осіб, що їх замінюють.

Ващенко А. Г. Уголовная ответственность родителей за доведение до самоубийства собственного несовершеннолетнего ребенка.

В статье рассматриваются проблемы уголовной ответственности родителей за совершение деяния, предусмотренного ст. 120 УК Украины, совершенного по отношению к собственным детям. В частности, рассматривается вопрос о том, чтобы дополнить ст. 120 УК Украины отдельной частью, предусматривающей ответственность за такое деяние, совершенное по отношению к несовершеннолетнему, родителей или лиц, заменяющих их.

Vashchenko A. Сriminal Рarent’s Responsibility for Suicide Their Minor.

The author dedicated the article to the issue of parent’s criminal liability for suicide of their children. The author analyzes scientific researches of investigation the issue of criminal liability of parents for violent offences against their children.

Pursuant to the legislation the Criminal Commission which try a case on offences versa adolescents is often consist of their parents or in loco parents.

The author proves the increasing danger of committing the suicide caused by influence of their parents. It also proves by several mass-media articles and scientific researches which have deal with the issue of adolescent victimhood.

The author also mentioned family law of Ukraine at the article. The Family Code of Ukraine states the parents obligation to ensure the proper upbringing of their children and to avoid cruel punishment of their children.

The author defends that the parents may influence their children to suicide as well as the same actions by stranger committed against a minor.

The author suggests adding the Art. 120 to the Criminal Code of Ukraine with the following text «the parents are responsible for their children if they made the suicide».

В статті розглядаються проблеми врегулювання правовідносин з надання адміністративних послуг шляхом видання відповідних законів. В статье рассматриваются проблемы регулирования правоотношений по предоставлению административных услуг путем принятия соответствующих законов. Проводится анализ теоретических основ законодательного регулирования указанных правоотношений. Исследуются соответствующие статьи Конституции и законов Украины. Предлагаются возможные варианты решения указанных проблем.

Vlasov A. The Issue of Legislative Adjusting the Granting of Administrative Services.

The article is dedicated to the issue of adjusting of administrative services by passing proper acts. The modern trends of subordinating regulatory acts are criticized when adjusting the procedure of granting administrative services by executive public and local self-government authorities. The analysis of theoretical bases of the legislative adjusting of the indicated legal relationships is conducted by theory of state power division. A thesis states that state executive power can not acts regulate a legal relationship, including legal relationship after the giving of administrative services, and such acts on the nature kogut to be turned to public officers of the proper bodies. The proper articles of Constitution and laws of Ukraine directly applicable or indirectly obligate to regulate activity of executive state bodies exactly by passing proper acts are probed. The issue of practical application of theoretical statement is analyzed by adjusting of granted administrative services by laws. It is offered possible variations of indicated issues decision. It is paid attention to the legal regulation of granting administrative services by reason of the social meaningfulness.

Войтенко Т. В. Диспозитивність як принцип цивільного процесуального права та його реалізація при розгляді справ про визнання шлюбу недійсним.

В статті розкрито зміст принципу диспозитивності як одного з принципів цивільного процесуального права. На прикладі розгляду справ про визнання шлюбу недійсним автор розкриває механізм дії даного принципу.

Voitenko T. Discretionary as a Principle of Civil Procedure Law and Its Realization in Cases of Declaration Marriage as Invalid.

The realization of justice on civil cases is impossible without scientific research and theoretical analysis of the valued measuring fundamental principles leading ideas of civil judicial law — principle of the civil legal proceeding.

In a scientific point of view expediency of theoretical study of principle of discretionary is that it serves as a tool for scientific analysis of the functioning civil procedure legal relationships in general and realizations of the civil procedure in particular.

An author in the article analyzes the scientific approaches to understanding the principle of discretionary, validity its valued loading as a fundamental principle of civil procedure law and reveals the practical value of this principle on the example of adjudication by the court cases of declaration marriage as invalid and compares discretionary and activity of the court in the present conditions of civil proceedings in Ukraine.

Researching this topic the authors is considering the principle of discretionary as valued measurement of civil procedural law.

Volokhov O. The Provision of Right to Strike in the International Acts Ratified by Ukraine.

The right to strike is one of the oldest ways of workers’ rights protection. Having a great historical background of foundation and development, this right is mentioned in special laws and constitutions of different countries all over the world, it is regulated by international legal acts and general principles of law. The role of strike in present Ukrainian conditions is growing, as taking into the account the problems of timely salary payment, low social guarantees etc. At the same time, the realization of right to strike is quite complicated task in Ukraine because of

different law restraints, gaps in national law and lots long termed formal procedures. Also most of these problems are unsolved by the current version of draft of the Labour code of Ukraine, which is at the second reading now. For example, there is a great need of new terminology, simplification of formal procedures and terms in this draft code.

To solve these and other problems the country should use the provisions of international legal acts when applying or upgrading its national labour law. At the same time, the way of realization of right to strike varies in different countries as it is mostly regulated by international regional legal acts. There are only few universal international legal acts in this sphere. It is resulted by employer’s unions’ position of restraining strikes and the attitude of International labour organization (ILO) to the right of strike: the organization is mostly concentrated on peaceful solution of labour conflicts, which is just the opposite to the strike. At the universal level the right to strike is provided by International Covenant on Economic, Social and Cultural Right 1966 which was adopted by Ukraine in 1973; and it is mentioned in Convention № 105 and Recommendation № 92. Also it is regulated by the principles of freedom of association committee of ILO, which arise from the interpretation of ILO Conventions №87 and № 98 and are analyzed for their accordance to Ukrainian labour legislation. As for regional legal acts, the right to strike is provided by the European Social Charter 1996, Community Charter of the Fundamental Social Rights of Workers 1989, Charter of Fundamentional Rights of European Union 2000. It is pointed out in the article that the subjects of right to strike are wider in article 6 of European Social Charter than it is in Ukrainian law. Moreover this provision of Charter allows the use of lock-out by employers in reply of workers strikes.

In conclusion, it is realized that Ukrainian labour law has some mismatches with the provisions of international legal acts in sphere of providing of right to strike ratified by Ukraine. So the recommendation is to follow these provisions during the next reformation of Ukrainian labour law, keeping in mind that providing of right to strike in some measures is needed to lower the social tension and to direct the discontent of workers to legitimated ways.

В статье рассматриваются и характеризуются процессы возникновения и развития частного права как правового явления, освещены особенности частного права на различных этапах развития общества, начиная от давних времен и заканчивая современностью. Раскрыто понятие частного права сквозь призму концепций современного правопонимания. Сосредоточено внимание на первичности частных отношений относительно публичных и сделана попытка авторского определения понятия частного права.

Zelena I. On the Issue of the Genesis of Private Law.

The article deals with the origin and development of private law as a legal phenomenon. Primary mentioned private law are reflected in the works thinkers of ancient times. The first one is of Tit Libya, and in fact private standards already exist, according to researchers and state law, the Laws of Manu and Laws Hammurabi. For example, the Laws of Manu called eight possible ways of ownership: inheritance, gift, purchase, conquest, usury, performance work, receiving alms, and possession of prescription. At the same time interesting is the fact rather more elaborated binding relationship and consequences that come once in their violation.

During the Middle Ages more broadly defines and reveals the private law, focusing on privately owned entity and its protection. An important step in the history of private law was, in particular, creation a Civil Code of France, better known as the Code Napoleon which were reflected and improved gains in private legal relationships and responsibilities and so called, the German Civil Code, which defines a number of provisions related to private law and liability.

The law of the Soviet period has imperative nature, was an aspect of state policy ensured party government, which was conditioned by the existing form State and legal regime. Herewith abstains the full expression, there was penetration of the state in all spheres of social life, the dissolution of private law as such a right in public. Inherent for this period is thought of the Ukrainian lawyer that time, Doctor of Public Law, M. Chizhov, that foundation is a private law not individual and public interests. When the state is taking care of all, it takes care both itself, in which case the individual and his private law is a means to achieve values useful for the whole community.

Modern views of private law based on the growth of social and personal values such as rights, promote democracy and human rights and citizens. A characteristic feature of modern legal science understanding private law is pluralism, which results in separation of different methodological approaches. In this private right of way is treated as a set of rules governing social relations in the private interest; higher area, represented by system-ordered unity areas of law based on the complexity of regulation, the industry right from their own features of the subject and method, identical to the concept of civil law, private law property rights, which is different in some areas of law.

Thus, the process of becoming private and private law originates since ancient times and continues to the present. Embryos private law is in ancient sources and is characterized by certain primitive and imperfect, however, this again confirms the idea of primacy of private relations of the public. During the Middle Ages more broadly defines and reveals the possibility of private law focusing on individual private property and its protection. The law of the Soviet period, on the contrary, denies the existence of private law, regulation bringing almost all areas social life at the state level. Modern views of private law based on increasing social and personal values such as law and strengthening democratic principles and human and civil rights.

Стаття присвячена дослідженню проблем реалізації принципу колегіального розгляду цивільних справ у провадженні у зв’язку із нововиявленими обставинами, зокрема, обґрунтуванню необхідності закріплення вимоги колегіального їх розгляду у порядку такого перегляду судових рішень.

Статья посвящена исследованию принципа коллегиального рассмотрения дел в производстве в связи с вновь открывшимися обстоятельствами, в частности, обоснована необходимость закрепления обязанности коллегиального их рассмотрения в порядке такого пересмотра судебных решений.

Izarova I. The Issues of Implementing the Principle of Peer Review in Newly Identified Circumstances.

The article deals with the principle of peer review of cases in production due to newly identified circumstances, in particular, the necessity of securing the collective responsibilities in order of their consideration of the review of judicial decisions.

Sustainable development of any field of law depends on exactness of definition and implementation in the sense of law principles. Thus, civil procedural law has a range of basic principles that define the features of its operation and development: the principles of optionality in civil process, its competitiveness, procedural equality of parties and others. At the same time, civil procedural law inherent in a number of principles which are interbrunch, or those that are inherent in two or more branches of law: the principles of justice only by the court, equality of all participants before the law and justice, independence of judges and their subordination only to the law, national language of justice and others., in particular, the principle of peer review cases.

The principle of collective administration of justice is enshrined in Art. 18 of Civil Procedure Code of Ukraine and determine the procedure and grounds for proceedings in civil cases by a single judge or panel of judges based on the type

of proceeding or category of case. Therefore, in accordance with this principle civil cases in courts of first instance are considered by a single judge who is presiding and acting on behalf of the court. By exception to this rule are cases where civil cases are heard by a panel of one judge and two people’s assessors — these are cases of separate proceedings.

In the courts of other instances, including appeals, the cases are heard by a panel of three judges and the court of cassation civil cases are heard by a panel of no less than three judges.

The defined procedure for review of judicial decisions in the panel of judges is quite clear, given the complexity of the proceedings. That is a general rule, the proceedings of the review of judicial decisions are made collectively, the only exception of it is proceeding in connection with the new circumstances, that is the object of our research attention.

It was defined the issue of compliance of application for review of judgment in connection with the new circumstances with the requirements of art. 364 CPC of Ukraine and should be decided by the judge-rapporteur, and the opening of the proceedings — by a panel of judges, and then in the order of proceedings issues in preliminary consideration should be settled on the preparation of the case to trial and the possibility of reconciliation parties. Thus, we provide general phasing of civil process, principles of optionality and competitiveness, and the principle of collective review in civil proceedings. It should be noted also that the subject of review in proceedings in connection with the new circumstances may be decisions of a court, which entered into force and which could be already done that necessitates peer review of this case.

Thus, based on the above, it is appropriate to consolidate the requirements of peer review proceedings of court decisions in connection with new circumstances and provide the procedure of general phasing of civil process — phases of opening proceedings, pre-trial proceedings and proceedings of cases in connection with new circumstances.

In conclusion, we emphasize that the existence of institute of peer review in civil proceedings has an important general theoretical and practical importance. The proceeding of cases with review of judicial decisions by the panel of judges is effective and necessary, especially in review of court decisions, which entered into force.

Knyazeva D. Legal Regulation of the Ukrainian-Spanish Relations in the Field of Economic and Industrial Cooperation.

The article investigates the characteristics of international legal regulation of these states in the sphere of economic and industrial cooperation.

It is noted that the balance of relations between Spain and the former CIS countries is very poor. This is especially true in Ukraine. However, these relationships are very useful for both countries, since relations between Ukraine and the EU are quite privileged, and it can raise the status of political relations with this country. However, there is a network of economic relations is very slow.

The basic legal act in this regard is the Agreement on economic and industrial cooperation. The adoption of this Agreement, the parties pledged to promote bilateral cooperation in every way. Identified the following sectors of cooperation: industry, construction, natural resources, energy and investment.

The agreement establishes the need for a special Joint Commission on economic and industrial cooperation. 08.07.2008 was held the first meeting of this committee, which identified such promising areas of cooperation: energy, agriculture, construction, tourism, etc.

In 2010 it was the second meeting of the said commission. It was devoted primarily on Spanish investments to Ukraine and on agriculture.

Thus, we see the practical implementation of this Agreement into effect. However, the existing legal framework is not perfect. To strengthen relations between Ukraine and Spain need to adopt an Agreement on the Limitation of double taxation.

Kozik M. Deontological Basis of Social Partnership with Police.

The deontological basis of social partnership police are characterized in the article. The basic deontological principles underlying social partnership with civil police and governmental entities in law enforcement are examined. The main deontological principles are respect, kindness, justice, honesty, responsibility, control, balance. These principles can be considered not only as the general standards of conduct, but also as principles that allow police to

improve cooperation with local communities and their community groups.

Social partnership with police and state bodies is based on free will, trust, respect and equity partnership. These requirements may follow mainly by moral guidelines. The positive experience of foreign countries police indicates the need to develop international standards based on their promising ways to interact with the public.

Nowadays there is a tendency to create universal standards of officers’ conduct in law enforcement. Each country has its own national characteristics, the history of the formation of social institutions, the concept of the state system, a system of views on professional ethics and deontology police, especially the formation of the Police. In view of integration processes need to develop common standards for operation of the most important social and legal institutions including police.

A specific object of deontological regulation of the police is the ratio of its and public interests.

Deontological regulation mechanism is the set of influence means onto police. Internal sources of self-regulation of this mechanism are necessity of implementation the behavior of police officers. The human life is criteria by which is created police needs. There is strict interaction between personal needs and inner world of individual, social activity and moral behavior. Hence the task of the education is to form individual needs, which would coincide with the requirements of society.

The principles of legal ethics are not exhaustive, it complements each other. The main of them are the following: humanity — means a respectful attitude partners and their rights, personal characteristics and interests; justice — ensures that the police will act impartially and in accordance with law; honesty — this principle is very important for the image of the police, it involves not only the honesty but also openness to himself; responsibility — the principle requires police and other agents of social partnership be responsible for their actions; control — requires a kind of

control over the actions of partners and associated with the previous principle. Thus, the activities of the police are social control; normativity — means relationships are subject to certain standards. This is not necessarily legal rules,

it may be moral norms, especially partner own rules, which he produced under the influence of various factors; timeliness — this principle means that police officers always should be informed in time to take the optimal solution. Even a small delay significantly affects the performance, the final result.

In was defined the role of ethics in police work. It was proved that deontological principles in the work of police and social partnership in particular aim to ensure high relevance to humans. On the law enforcement agencies protect the interests of the person’s life, honor and dignity. It is important for society to increase quality of police officers professional duty. The main purpose of partnership is to strengthen law and order, protection of citizens from illegal encroachments, improving the legal culture and legal awareness, and creating a positive image of law enforcement. Deontological principles of humanity, benevolence, justice, honesty, normativity consider general standards of conduct. They allow police to improve cooperation with local communities.

Kravchenko V. Definition of Labour Migration.

This article deals with the different scientific approaches to understanding the concept of «labor migration», «migrant worker» and the definition of these terms in the legislation of foreign countries and international conventions.

As a rule, labor migration means movement to another country for employment. It is a special type of migration of economic nature. In contrast to permanent migration it is typical for labor migration the preserve of the constant connection of migrant with his/her family both in personal information and economic forms. However, there is no generally accepted definition of labor migration. The concept and definition of labour migration often reflects current national policy perspectives and varies in different countries and over time.

As the equivalent to the term «labor migration» sometimes the term «economic migration» is used. However, these two terms may include different categories. The term «labor migration» may be used only to determine the movement for employment purposes while «economic migration» can be used both in narrow sense which includes movement for employment and in general including other types of economic activity such as business.

The terms «labor force migration» and «work abroad» are used as synonyms to «labor migration» in scientific discourse today. However, they are different in their contents and in essence phenomena.

International instruments such as the UN and International Labour Organization (ILO) Conventions use different definitions. Most international conventions define as migrant workers only those persons who are lawfully stay and employed in another state. Illegally employed foreigners are not considered as migrant workers.

Furthermore, labor migration is regulated primarily by national migration legislation. Countries have developed various types of admission policies to meet their labour market needs and priorities. These usually distinguish among several categories of workers according to the duration of their state, their skills, and their legal status.

The current tendency of labor migration in Ukraine is characterized as legal and illegal leaving of a large part of the economically active population of the state with the aim to work abroad, transit migration to Western Europe, an increasing number of labor immigrants. However, the migration legislation of Ukraine has not defined the concept of such categories as «labor migration», «migrant worker» yet.

This article formulates the typical features of labor migration: voluntary and temporality, economic motivation (unemployment, low wages), goal — employment (legal or illegal), crossing of state borders.

Despite the absence of the unified and generally accepted definitions of these phenomena the author tries to determine them. In the broad sense labor migration is the movement of a person abroad for employment purposes. In the narrower sense labor migration should be understood as the voluntary movement of persons across the state border for temporary employment. A migrant worker is a person who is engaged in paid labor activities outside his/her home state.

In the article the author proposes to consolidate the terms «labor migration» and «migrant worker» into the legislation: for example, in the Labor Code of Ukraine and in the revised Law of Ukraine «On Employment of Population». It will help to provide better protection of Ukrainian citizens working abroad and improve the

administrative and legal regulation of labor migration in Ukraine.

The article is devoted to complex research of regulation terminology in the legislative system of Ukraine. In this thesis the author gives a detailed analysis to general theoretic problems of idea, features, and essence of the normalization of terms, their place in the hierarchic system of Ukrainian legislation.

The investigation of special law terminology which gives the opportunity to describe the integral picture of the legal terminonological system inventory at the modern stage of the normative language development, as well as general theoretical issues concerning the process of formation and functioning of law terms as units of primary and secondary nomination.

A special attention is paid to the problem of unification normative legal terminology. The unification is one of the forms normalization legal terminology. It is important to say that the process of unification intends for improvement of communication efficiency of normative legal acts. It are listed principal requirements of correspondence legal terms. A certain set of bases and word-forming elements was proved to facilitate the professional understanding of specialists in the law sphere and present a kind of scientific information guide.

This article is focused on peculiarities of notions by «unification», «harmonisation» and «standardization». These forms of normalization terminology contribute to precision and clarity of presentation of legal formulation.

Kuyan І. «Sovereignty» as Basic Category of Institutes and Principles of Constitutional Law of Ukraine.

Article is devoted to research the place and role of the category “sovereignty” in constitutional law of Ukraine. Sovereignty is a fundamental category that has dominated a number of political and legal concepts and categories as follows: «government», «form of government», «state power», «public functions», «state apparatus», «citizenship» and so on are based on its basis. Thus, sovereignty as fundamental constitutional and legal principle makes the whole system of principles and content of the institutions of constitutional law. In the field of constitutional law, this category serves as a basic principle which all basic institutes of constitutional law are based on: the foundations of the constitutional order, public authorities (including the Institute of the President, the legislative, executive and judiciary, constitutional justice, prosecutors, etc.), democracy (direct and representative democracy forms) human rights (especially in the institute of citizenship), name of the state, official language, territorial organization, local

government and others.

It was studied the relationship between category “sovereignty” and the general principles of constitutional law. These principles include the principle of publicity, priority, universality, scientism, democracy, active efficiency, continuity, consistency, programmaticy. The idea of sovereignty in the triple Unity (state, nation, national) acts as a basic fundamental principle of democratic organization of constitutional law. State sovereignty defines the basic nature, content, direction and forms of constitutional and legal regulation. Firstly, considering the fact which is concentrated expression of the value of a sovereign state as one that is able to provide harmony in society. Achieving this idea is the main goal, the task of constitutional and legal regulation. Secondly, the principle of sovereignty subordinates all other general and particular (special) principles of constitutional law.

The principle of sovereignty is fundamental nature for principles of these institutes as well as general principles of constitutional law and carries of subordination role.

Lukianov O. Cooperation of United Nations Peacekeeping Missions: Participation of Ukraine.

This article examines certain aspects of Ukrainian participation in inter-mission cooperation of peacekeeping missions.

This topic is particularly essential for Ukraine because Ukrainian peacekeepers from 56th Separate Helicopter Detachment played important role in one of the most recent examples of such cooperation in Cфte d’Ivoire and saw action during this deployment.

In Ukraine this topic has not been subject to significant legal research. Abroad it was studied by, for example, Victor Angelo in Inter-mission cooperation Reflecting on Sudan and Central Africa Experiences. The goal of the article is to examine national legal mechanisms of participation of Ukrainian peacekeepers in inter-mission cooperation.

The article starts with a brief introduction into international developments in this area (limited resources of United Nations, report of the Secretary General on inter-mission cooperation, situation in Cфte d’Ivoire) and then examines Ukrainian experience in inter-mission cooperation mostly from national point of view and in conjunction with national legislation. It follows a chain of laws, presidential decrees and resolutions of government which formalized the decision to redeploy Ukrainian troops from United Nations Mission in Liberia (UNMIL) to United

Nations Operation in Cфte d’Ivoire (UNOCI). Ukrainian troops were already deployed to Liberia and a decision to provide support to UNOCI had to go through the same process as any other decision to participate in a peacekeeping operation — it was taken by President signing his decree and then affirmed by Parliament voting for respective law. The only difference it that troops were deployed from the neighboring mission and not from Ukraine itself.

There were several interesting issues. For example, at first parliament authorized Ukrainian presence in Cфte d’Ivoire for three month while United Nations Security Council resolution 1967 (2011) extended their mandate only for four weeks. Ukrainian Parliament also adopted special resolution making two important recommendations to Cabinet of Ministers: (1) to make sure that Ukrainian unit in Cфte d’Ivoire will be manned solely on voluntary basis and (2) to increase pay of personnel deployed to this mission in 2,5 times. Both recommendations were taken into account and deserve to be applied if this practice is continued.

Yet the most important question is whether this practice should be continued. Positive answer to this question would warrant respective changes to guiding documents — from capstone documents that define the very framework of Ukraine’s participation in peace operations to manuals that describe participation in lower levels.

If Ukraine supports inter-mission cooperation it makes sense to use Ukrainian voice and vote in United Nations institutions to promote this idea. One has to be ready to accept an invitation to more active participation in intermission cooperation than.

While making changes to national legislation Ukraine will also need to augment these measures by undertaking steps to foster further discussion and normative regulation of this matter in international level, particularly removing disagreements between these two levels. Ukraine shall also display caution while deciding whether to participate in operations that is likely to use force (like in Cфte d’Ivoire).

As the topic of inter-mission cooperation is extremely broad, any of its elements merits separate and detailed research. This form of international cooperation is fairly effective right now, in a given region at a given time. It will probably generate enough empiric material for a proper analysis.

Melnik A. Quality as Principle Requirement of Effective Law.

This article provides analysis of the quality of law through the understanding of its philosophical and philological sense. Comparison of various ways of understanding and interpretation of the term «quality» is provided in order to

define its clear meaning. Law quality criteria are determined in accordance with their properties. There are several levels of understanding the essence of quality. According to Aristotel, who was one of the first to give a certain definition of «quality», the quality is the essence that helps any object or process to obtain certain features, which may be judged as a quality features under specific conditions. In literature it is often defined that quality has its inner core, which describes the quality as a basic form of effectiveness and does not depend on human evaluations. The secondary (outer) core is based on human views that are often subjective. Subjective view on the quality itself is a powerful tool of creating laws and adopting them to a specific country, nation or social group.

Philological definition of laws is not less important. For instance in Ukrainian philology term «quality» is defined as a number of criteria and features of an object, which make it unique and unlike others, make it more valuable or useful for specific uses.

Philosophical interpretation of the term «quality» is based on the understanding that only the sum of relative criteria and specifications may be the basement of understanding real quality features of any object or process. According to philosophical view on the quality of law, the level of law effectiveness may be determined by law quality features. In this article, law quality criteria were examined, as well as components and elements which identify the quality as the main requirement of current law.

The identification of the basic quality criteria of law is the basis of setting standards of law quality. Worldwide practice of implementation of law quality standards shows the importance of effectiveness or current laws. These international standards can be seen in international law documents, agreements, international conventions, the spread of which is not limited by a single country, nation or even continent. Due to the international coverage, it is vital for those laws to be designed with the highest standards of effectiveness.

Standards of law effectiveness may be defined as a complicated system of template ways of building laws, which contains most valuable components that may be implemented in the process of creating laws. Components used in the process should have contemporary nature and moreover they have to reflect the current social issues, together with the perspectives of social relations development.

Mozolyuk-Bodnar L. Social Value and Purpose of State Discipline.

Pursuant to the article the modern state modernizes and promotes the functions of state discipline. One of the modern legal science’s tasks in the context of the «state discipline» phenomenon should be understanding and theoretical development of its functions.

Under state discipline functions we should understand the basic directions of influence on social relations related to the effective implementation of the basic rules, requirements, standards (content of state discipline), which manifests its social and legal purpose in society.

Function of state discipline characterized by the following features: 1) they are closely associated with the state, as they partially shown and specified activities of the state, but they are much narrower than the functions of the state, while expressing the most significant features of state discipline; 2) conditioned by the operation and activities of the State, a change to some extent may modify the content of these functions, thus, on the one hand, their dynamic is nature, the other — constant (when the battery power of one political party); 3) close communication with the law because of certain functions of state discipline might be a rule of law.

We can select the following functions of state discipline, depending on the scope of influence on social relations: 1) general and social — economic, political, administrative, cultural, moral, ecological, informational, cognitive, restrictive and 2) legal — regulatory, security.

We assume it’s necessary to consider some of these functions, including environmental, cognitive and information restrictive, since these functions are relatively new in the context of analysis of state discipline and fairly in accordance

with current realities of today.

Including compliance with state discipline in the field of ecology in the modern period is very important. As the problem of providing state discipline in the field of rational use of nature and natural resources the Ukrainian state while not fully resolved. The function of the state discipline in the field of ecology is in compliance and enforcement established by the state legal and moral standards to protect natural resources and its rational use, and determining the order of the state and public organizations and their officials in the process of national goals practical realization.

Providing of state discipline in information and cognitive field is present to the subject of public relations to certain rules, requirements, standards (information) to be properly learn and implement (through active or passive behavior) to ensure the regularity and consistency of public relations. However, the receipt of this information may be from different areas of economic, political, cultural, and environmental and so on. That is why this function is a kind of «springboard» for the proper implementation of other state discipline functions.

Restrictive function of the state discipline is to a certain adjustment of social relations through the regulation of different behaviors, which aims to ensure the regularity and consistency of public relations. This function is characteristic of the functions of law in general.

We believe, as the state discipline is not only legal but also moral standards, therefore it is designed to ensure orderliness and efficiency of the main directions and tasks of the state in any sphere, coupled with moral and legal values. Thus, the functions of state discipline are becoming more complex and diverse, which is due, primarily, the state development and its needs.

Musiienko T. The Principles of Public Administration in Renewable Energy of Ukraine.

An important factor in understanding government administration is realizing its principles.

Taking into account the increasing role of renewable energy sources in the world and particularly in Ukraine, and realizing the extremely important role in the effective administration in this sphere, in our opinion, it is necessary to define the basic principles for government administration in renewable energy sector.

The purpose of this paper in to analyze the principles of public administration, principles of renewable energy policy in Ukraine, but what is most important, giving the definition of the principles of public administration in renewable energy and also telling them.

In this paper the author have examined different approaches to scientific definition «administrative principles», it was also proposed the definition «administrative principles in renewable energy».

The author assumes that principles of public administration in renewable energy are the basic rules and ideas, objective regularity of development in renewable energy and of the acting government, which represent the most significant and the main patterns and relationships that are intended to promote this sector.

The author pays attention to the principles in renewable energy policy of Ukraine given in the Renewable energy sources act because she insists on the link between the principles in renewable energy policy and the principles of public administration in renewable energy.

It is said that the principles in renewable energy policy of Ukraine are the follows: principle of increasing the amount of the production and consumption of renewable energy, what will lead to reduce of Ukraine’s dependence on imports of traditional energy sources, the principle of attracting domestic and foreign investment and promoting business in the renewable energy sector including though the investigating and implementation of the national and local programs for renewable energy.

Approaching to the defining the principles of public administration in renewable energy the author emphasizes on division them into general and special.

To the author’s mind, the common (general) principles of public administration in renewable energy are follows: the rule of law, democracy, transparency, the principle of citizen participation in government action which guarantees citizens opportunity to be involved in public affairs and equal right to public service or service in local government, the principle of the state responsibility to the people for its activities in renewable energy which consists the necessity of publishing the work results of administration in the sphere of manufacturing, transportation and

using of renewable sources and also citizen’s ability to express distrust of officials challenge the illegal actions in court and some others.

Special principles are fundamental ideas in the sphere of renewable energy administration. The author defines such principles. They are follows.

The principle of a flexible administration system means for each type of renewable energy source, the maximum investment promotion in the renewable energy, the principle of supporting professionals to ensure the industry, the principle of coordination of the state authorities, local authorities and businesses (especially small businesses), the principle of giving the crucial role of coordinating body in the sphere of renewable energy.

Due to the fact that the administration principles in renewable energy are fundamental and basic for the whole process of this industry, the author proposes them to be fixed into the Act of renewable energy sources in the part concerning public administration and the state regulation in this sector.

Nigreieva O. Sovereignty as Responsibility: New Comprehension of Concept.

In the article the author touches some issues of sovereignty concept transformation in the modern conditions. Beginning with consideration of the classic sovereignty theory that during a long period of time was recognized as an almost unique possibility, the researcher turns to one of its recent conceptions — to the conception of «sovereignty as responsibility», proving regularity of its appearance. For years sovereignty was one of the most important characteristics of a state that was making it legally independent and free from influence of other international

law subjects. Nowadays realities want the classic sovereignty conception to be changed as far as it prevents from solving of some important international tasks. One of such tasks is the human rights defense. At the end of the 20th century the mankind became a witness of the great tragedies that had place in the former Yugoslavia, Ruanda and others places of the world. One of the main reasons of genocide crimes in these countries was impossibility of the international society to intervene in the events as they were realized in territories of the sovereign states. So the quality of sovereignty became an obstacle to prevention of such serious and grave international crime as the genocide crimes. In these conditions the sovereignty is connected with questions of international law, such as: when, if ever, is intervention by one country or several countries or an international organization onto another’s territory permissible? Inaction in response to the Rwanda genocide in 1994 and failure to halt the 1995 Srebrenica massacre in Bosnia highlight the complexities of international responses to crimes against humanity. In 2000, the Canadian government and several other actors announced the establishment of the International Commission on Intervention and State Sovereignty to address the challenge of the international community’s responsibility to act in the face of the gravest of human rights violations while respecting the sovereignty of states. It sought to bridge these two concepts with the 2001 Responsibility to Protect report. In 2005 the responsibility to protect doctrine was incorporated into the World Summit outcome document. The document did say it was every state’s responsibility to protect its citizens from genocide, war crimes, ethnic cleansing, and crimes against humanity. If a state fails to do so, it then becomes the responsibility of the international community to protect that state’s population in accordance with Chapter VII of the UN Charter. Chapter VII includes use of military force by the international community if peaceful measures

prove inadequate. The UN outcome document was unanimously adopted by all member states though is not legally binding. Such an approach of the international community to the intervention possibility means a serious change of the classical sovereignty conception that may conduct to changes in the conception of state itself. Some author’s thoughts that concern to these changes are exposed in the article.

Pavlenko I. Does Pregnancy of Victim may be Recognized as Aggravator of Illegal Abortion?

The article examines the possibility to count the pregnancy of victim as aggravator of illegal abortion. This issue was aroused in criminal cases legal practice of Ukraine in respect of Article 134 of the Criminal code of Ukraine. Consequently by basis for writing of the article and there are materials of these criminal cases. In addition, the article gives different scientific points of view regarding aggravator, in particular, it was mentioned the view of N.F. Kuznecova, S.S. Gaskin, L.L. Kruglikov.

The article examines the division of aggravating circumstances on the following: foreseen by General part and by Special part of the Criminal code of Ukraine. Pursuant to the above mentioned the author divided into groups the aggravator as state of pregnancy of victim at the feasance of illegal abortion and in general aggravator in the context of item 134 the Criminal code of Ukraine.

An issue is separately affected by influence of aggravator on foundation and pre-condition of criminal responsibility in general.

As a conclusion lead through of abortion is illegal and foresees the presence of pregnancy. Consequently, pregnancy is a structural sign of crime, responsibility for which is foreseen by Art. 134 of the Criminal code of Ukraine. The author of the article comes to the final conclusion that the pregnancy of victim in context of illegal lead through of abortion is not and can not be a circumstance which burdens punishment.

Padalko G. The Principles of Local Self-Government, Municipal Law and Service in Local Self-Government Bodies in Ukraine: Issues of Correlation and Interaction.

The article is dedicated to the theoretical and methodological issues of definition and understanding the principles of local self-government, municipal law, and service in local self-government bodies in Ukraine. In article conceptual problems of formation of principles of service in local self-governments bodies are considered.

The analysis of actual problems of the theory and practice of institutionalization of local self-government in modern Ukraine led to the conclusion of the dynamic process of formation of the principles of municipal law, and service in local self-government bodies.

Theoretical developments in this field indicate an important stabilizing role of the principles of organization and operation of the service in local self-government bodies.

All the principles of organization and operation of the service in local self-government bodies act in cooperation within the framework of a mechanism, a single system. Building such a system has both an empirical and practical importance.

System analysis of the principles of organization and operation of the service in local self-government bodies can fully take into account their communication and relationships in the middle of the principles of service in local self-government bodies, to find the conditions of their dynamics and stability, to understand the mechanism of their impact on social relations in order to effectively implement the process of modernization of the system service in local self-government bodies.

Plotnikova M. General Description of the State Regulation of the Bank Aktivity in Ukraine.

State regulation of financial markets — one of the most important and most difficult tasks of the state. Correctly organized financial policy is the most important factor in the successful economic development of any country.

The social significance of the banks and their accountability to the society led to the emergence of regulation this sector.

Many scholars analyze the financial regulation of the banking sector, but the issue of the state regulation, in our opinion, is given insufficient attention.

The article grounded idea that the state influence on the banks activity in order to balance the private and public interests is a regulation.

The origins of the state regulation of the banks as business entities of capital market are in the past and improved with the formation of the financial business.

The legislation contains no definition of the state regulation of the banks activity, but the term is used. The author of the article analyzes the provisions of the Law of Ukraine «On Financial Services and State Regulation of Financial Services», that the National Bank of Ukraine carries out state regulation of banking services. These provisions are compared with the Law of Ukraine «On National Bank of Ukraine» that the National Bank is a body of the state administration.

We present position of scientific irrationality of governance in banking. Banking institutions are not subject to the National Bank of Ukraine, but carry his orders.

The author substantiates the position that the impact of the National Bank on the bank is state regulation. The purpose of this regulation is the coordination of private and public interests. Private interests of depositors — is the reliability and reasonable cost of services provided. The private interest of the bank — get more profits. All of society has an interest in the stability of the entire banking system.

Value concept of banking regulation and state regulation of banks activity considered in the paper. Position when these concepts are identified, criticized.

Attention is accentuated on the fact that the National Bank of Ukraine carries out state regulation not only banking, and state regulation of banks activity.

Because banking is an exclusive list of operations defined by the Law «On Banks and Banking», and the banks activity includes and other financial operations. In all of these operations the bank must comply with provisions of the National Bank of Ukraine. The author determines that the National Bank carries out state regulation of banks activity by: 1) regulation of these relations, 2) maintain a system of refinancing, the national payment system, make recommendations, and 3) issues licenses and monitors compliance with banking laws.

As a result, it is concluded that the impact on the bank of the state takes the form of regulation.

The state regulation of banks activity is defined as a combination of the legal, organizational and economic measures that the National Bank uses to ensure the stability of the national currency of Ukraine, the stability of the banking system and price stability.

Prykhodko К. The Principles of Representativeness and Disintermediation at the Constitutional Procedural Law as its Value Orientation.

The article is epistemological and axiological analysis of the legal nature of the categories of «representativeness» and «disintermediation» as PoCPL. The author highlights the essence of their values and goals as long-term development of the constitutional process.

On trends in use of disintermediation in Ukraine shows, for example, the introduction and use of automated information and communication systems and technology in the practice of the election. In theory and practice of constitutional jurisdictional process all the more urgent question of the constitutional complaint, this, in essence, is the result of disintermediation. In the municipal process occurs widely used technology of inter-municipal cooperation and functioning at the municipal level as close as possible to the needs of the community — community

organizations, public forums, community councils, and centers of municipal services. The author focuses on repeating a pattern of application technology of e-governance at the local level.

Analyzing the representativeness as a principle, characteristic and function of Parliament author concludes that one of the problematic aspect of it is to preserve this trait since its purchase and at all stages of implementation of the representative function of Parliament, especially on the stages of approval and acceptance of decisions on behalf of the people. In this regard, restraining and limiting factor of abuse of power can be considered representative disintermediation as the principle of participation and access in the form of a combination of representativeness. One

striking example is the interactivity of Parliament, which is provided by new information technologies. Information of the legislative process is subject to international legal standards gradually introduced in Ukraine.

The principle of representation as one of the principles of the PoCPL is determined as one of the originating ideas of constitutional and procedural functioning and development of constitutional and procedural relationships, which relies in existence of the necessary representative institutions providing procedural feasibility of subjective rights — as the final result. Principle of disintermediation id interpreted as a source idea of functioning and development of constitutional and procedural relationships in the form of direct participation and public access in law execution process in its narrow sense. The value of this principle is first to optimize the legal procedures (reduction, balanced, judicial economy). In doctrinal terms of implementation and application of these principles in theory and practice of the constitutional process implies an iterative process, because their formalization in each stage can have its own peculiarities. In the applied aspect — those guidelines allow the coordination of public-private and private-public aspects of constitutional and procedural support and consideration of its cuts in the legislative process secured by constitutional and procedural techniques (including legislative technique).

Semchyk О. The Principles of Public Financial Process as Conceptional Categories of Financial Law.

The article shows that main peculiarities of the principles of public finance as fundamental categories of financial law. The principles of public financial process form the criteria for financial legislation development that reflect the inner essence of the legal regulation of financial relations. The disputable aspects of principles interpretation, concerning financial process are brought to attention in this article.

Firstly it is noticed that public financial process should be based on the main general legal principles, including the supremacy of law, legality, transparency ect. Secondly the key financial principles, that that reflect financial relationships are described.

The principle of prevailing public interests over private is carried out to an attention. It focuses the need to take to an account the national and public interest in the actions of the state, carried out within public finance. The particular characteristics of the principle of rationality and reasonableness in legal regulation of financial relations are shown. It is shown that although the principle of priority of public expenditures is one of the axiomatic for financial law, the question of its implementation into the practice is currently unsolved.

The particular qualities of the principle of financial regulation social orientation are shown in the article. It is unclear how to determine the real solvency of the taxpayer, as will be provided with the principle of fiscal adequacy fixed in the same article code, which provides for the establishment of taxes and duties with regard to the need of reaching the balanced budget expenditures with its revenues. Moreover, the very essence of the principle of justice is therefore to achieve a redistribution of social wealth, which would provide adequate living conditions for the Ukrainian people. An interpretation of tax law shows that as it is rather contains the privileges and benefits to individuals rather than reflects the actual content of the principle of justice.

It is made an conclusion that the implementation of each of the general law principles or any financial principles are closely related to the subjective perception by the subjects of relations, who are responsible for applying these

principles in their work.

Simutina Y. Presumptions of Law and Their Intercommunication with Principles of Labor Law.

Presumptions of law are investigated in the context of their intercommunication with principles of labor law of Ukraine. Basic presumptions, that represent the specific of the field of labor law is analyzed, their meaningfulness for the legal adjusting of labor relations on the modern stage is grounded. The features of application in a labor law for such types of generally accepted presumption, as presumption of knowledge of law and honesty of parties of labor relations open up. It is proved that presumption of honesty by analogy with a civil law must find the direct fixing in text of the Labor code of Ukraine, as well as principle of impermissibility of abuse of right by the subjects of labor legal relationships.

It is underlined that among branch presumption-principles of labor law, presumption of unreality of terms of labor agreements, that worsen position of worker comparatively with legislation, has a substantial value. Now in the conditions of distribution of the so-called off-type employment one of important legal presumption in a labor law it follows to admit presumption of labor relations.

Presumptions in a labor law in intercommunication with legal principles express essence of the legal adjusting of labor and closely associated with them relations, determine the orientation of labor law as a field of law. In them, from one side, initial fundamental principles of labor law are represented, and on the other hand, they have the mechanism of realization of these basic principles. As important factors of the field of labor law presumptions are called to set certain guarantees for workers from the wrong acts of employer, that is predefined by the protective

function of labour law.

Surzhynskyi М. The Principles of Citizenship: Concept, Theoretical Problems of Systematization and Classification.

The author analyzes different scientific approaches defining essence and core issues of citizenship.

The definition of principles of citizenship is given as well as theoretical problems of systematization and classification of such principles is studied.

As reflected in the legislation, the principles of citizenship, first, themselves are of regulatory importance, and, secondly, considered the source of legal regulation with regard to citizenship issues.

It is worked out that the principles of citizenship: 1) reflect the nature and content of the citizenship; 2) are the regulatory basis; 3) are direct; and 4) considered the source for the government practice in citizenship sphere; 5) influence person’s behavior and amount of freedom is granted; 6) are an important indicator of the democratic state.

The following classification of citizenship principles is proposed according to the article: depending on definition and place the principles occupy in the system of citizenship principles — general and special principles; depending on legal act bearing such principles — principles defined by Constitution of Ukraine and principles defined by Law on citizenship of Ukraine.

Analysis of international public-law documents allows the author to claim that the principles of citizenship contained in such documents, on the one hand, characterize citizenship as an integral institution of law, and on the other — regulate specific legal relationships arising with respect to citizenship.

Principles of citizenship are complex and multifaceted phenomenon. The principles are the foundation that links together various components of citizenship, successfully reflects its essence as a single legal institution.

Tsyupryk N. The Principles and Grounds of Administrative Responsibility of Law Enforcement Officers.

The analysis of the scientist views for understanding the concept of reason and the principles of the administrative responsibility of law enforcement officers in the article is an attempt to establish the specificity of categorical understanding and describe the features.

By determining the administrative responsibility of law enforcement officers it has a number of features caused by their tasks, which follow strict unity of command and discipline for the effective implementation of prevention of crimes and other offenses, their detection and investigation, supporting law enforcement activities. Administrative offenses committed by employees of police during the performance of their official duties, are characterized by common features inherent to any administrative misconduct. The essential difference that allows them to select an

independent group is the subject of attack — policemen.

The author argues that classification basis of principles of the administrative responsibility of policemen provides state of the complex nature of the liability of these entities, including the content and specificity of their powers.

The results of the administrative responsibility of policemen in the context of the essential basis of its principles led to the conclusion that an essential aspect of the principles of the administrative responsibility of these entities has its procedural nature, which provides them the most complete implementation of the vital functions of society and requires a further analysis.

Щербанюк О. В. Визначальна роль народного суверенітету для конституційного принципу народовладдя.

У статті досліджуються актуальні проблеми народовладдя в Україні. Проаналізовано поняття народного суверенітету як принципу конституціоналізму, його політичні та правові характеристики. З’ясовано,

що конституційний принцип народного суверенітету не зводиться тільки до теоретичної конструкції, яка розкриває природу влади, а має конкретні прояви в правозастосовній практиці, в тому числі в реалізації суверенних прав держави. Досліджено широке трактування народного суверенітету. Виявлено, що в науці конституційного права останніми роками з’явився підхід, відповідно до якого народний суверенітет та народовладдя розглядаються як конституційні цінності та правові пріоритети сучасної України.

В статье исследуются актуальные проблемы народовластия в Украине. Проанализированы понятия народного суверенитета как принципа конституционализма, его политические и правовые характеристики. Выяснено, что конституционный принцип народного суверенитета не сводится только к теоретической конструкции, которая раскрывает природу власти, а есть конкретные проявления в правоприменительной практике, в том числе в реализации суверенных прав государства. Исследованы широкая трактовка народного суверенитета. Выявлено, что в науке конституционного права в последние годы появился подход, согласно которого народный суверенитет и народовластие рассматриваются как конституционные ценности и правовые приоритеты современной Украины.

Shcherbanyuk O. The Decisive Part of Popular Sovereignty for the Constitutional Principle Sovereignty of the People.

It is analyzed the urgent problems of sovereignty of the people in Ukraine. In the article is investigated the definition of the term sovereignty of the people as principle of constitutionalism its political and legal characteristics. It is clarified that constitutional principle of popular sovereignty is not only theoretical structure which discovers the nature of power, but has particular display of law enforcement experience and sovereign rights of the state. The wide interpretation of the popular sovereignty is researched.

Nowadays popular sovereignty and democracy are considered as constitutional values and legal priorities of modern Ukraine.

Sovereignty is not the right at whole but special characteristics of the state, people or nation, which is provision, cause of some rights. The theories of «limited sovereignty» and «separated sovereignty» are analyzed.

It is proved the determinant role of the popular sovereignty for constitutional principle of democracy. Construction the system of state and law in our country on the basis of doctrine of natural (common) and inalienable human rights is through binding sovereignty of people in the Constitution. Principle of government by the people can be classified as following: people are the main source of supreme power of the state, public authority exists only in their interests, nation has the supreme right in solving problems of state and social life, formation of organs of public authority to fulfill the function of political government and control of their activity.

У статті досліджено сутність поняття «відкликання представника» як особливої правової категорії у теорії та практиці народного представництва. Проаналізовано різні підходи до тлумачення поняття та суті відкликання, з’ясовано особливості механізму його реалізації на практиці. Автором сформульовано власне бачення ризиків та доцільності використання зазначеного правового інституту на практиці в умовах сучасного розвитку суспільства.

В статье исследовано сущность понятия «отзыв представителя» как особенной правовой категории в теории и практике народного представительства. Проанализированы разные подходи к толкованию понятия и сущности отзыва, выяснены особенности механизма его реализации на практике. Автором сформулировано собственное виденье рисков и целесообразности использования отмеченного правового института на практике в условиях современного развития общества.

Yurkevych K. A Recall of the Representative in the Theory and Practice of Folk Representative Office.

In the article the essence of concept «recall of representative» as a special legal category in a theory and practice of folk representative office is investigated. It is analysed different ways of interpretation of concept and essence of the recall, the features of the mechanism of its realization in practice are found out. An author has formulated her own vision of risks and expedience of the use of this legal institute in practice in conditions of modern development of the society.

The improvement of the practice of folk representative office functioning in the modern state predetermines the necessity of decision of row of related to its state creative problems. One of the most debatable is a problem of recall of folk representative, which is related above all things, with ambiguous interpretation of concept and essence of the recall, to the mechanism of his realization in practice. In theoretical and practical aspects of question of recall of representative it was and remain the object of scientific study of foreign and domestic research workers, in particular S. Avak’yana, E. Berka, N. Vaganovoy, V. Zhuravskogo, E. Kurmanova, O. Malka, N. Nikiforovoy, N. Petrovoy, O. Radchenka, V. Rudenka, V. Sinyukova and others. In that time the problem of recall of representative does

not lose the actuality and needs continuation of the special scientific analysis. Taking into account it, consider a necessity to consider the noted problem more detailed.

There are different decisions of concept «recall» in scientific literature. Thus, the recall of the representative can be examined in different values. According to different conceptions the recall can be examined as a component element of institute of imperative mandate and as an independent institute of the law. In this context extraordinarily interesting is a question of recall in the foreign states. A recall is an extreme display of imperative mandate, but this institute exists also if the elective person has a free mandate.

A mechanism of realization of the recall of representative in practice is sufficiently difficult, that is bound with the contradictory understanding of essence and setting of recall. The ambiguous is seemed by understanding of grounds of recall of representative. Except for that, incomprehensible criteria and subjects of estimation of the proper acts of representative. As a result, subjectivism in understanding of this problem generates substantial complications in the process of realization of recall in practice.

Summarizing the above-mentioned, it follows to accede to the idea about inefficiency of recall as a result of scale and obviously incommensurable organizationally financial, material and technical, social and political, morally psychological problems which arise up at a necessity the use of this measure. Actually that is why, the recall of representative seems inwardly contradictory and doubtful enough in a political plan, that and it is needed to take into account at perfection practices of folk representative office in the modern terms of creation of the state.
