Бобровник С. В. Конфліктогенність сфери реалізації суб’єктивних прав.
Досліджено форми прояву конфліктогенності у сфері реалізації суб’єктивних прав та запропоновано можливі шляхи її подолання. Особлива увага приділена аналізу прояву конфліктів у сфері реалізації конституційних прав громадян на
інформацію та свободу слова.

Исследовано формы проявления конфликтности в сфере реализации субъективных прав и предложено возможные пути ее преодоления. Особенное внимание уделено анализу конфликтов в процессе реализации конституционных прав граждан на информацию и свободу слова.

Bobrovnik S. Conflictogennity sphere of realization of subjective rights.
Using the law as one of the main forms of the right, along with implementation and compliance, has several features known to science. Chief among them is that the existence of this form gives the right to each particular person the feeling of being a citizen, to use advanced science and technology, civilized way to meet the individual needs of personal and cultural development. Use the right is in the active implementation of legal opportunities offered by the various entities of public relations [519, p. 606]. Within this form there is the right of subjective human participants in social life. These rights as stipulated in the Constitution of Ukraine and other regulations system of national legislation of Ukraine.

Citizens of Ukraine at the present stage of development of the state are faced with many factors exist which affects the efficiency of all forms of human rights. Among them distinguish legal conflicts arising from the use of a national law within public or private legal relations.

Current practice requires legal science comprehensive study of various legal disputes, which are formed in the use of the legal right of citizens. Given polivariatyvnist and multidimensional conflicts are possible in the use of human citizens of Ukraine, conduct legal analysis of the realization of the rights of use of which is, in our opinion, the most conflict.

1. Analysis of the legal conflict and compromise using legal citizens of certain rights, singling out their features and specifications guidance gives rise to formulate a conclusion that the nature of conflict and the content of standards-declarations in the field of law within the national legal system associated with minor binding legal force of rights provided for citizen law.

2. Perceptible conflict problem use of certain rights is a conflict between the provisions of the act (acts) of national law which reinforce the citizen's right, but also does not fix the precise mechanism and optimal use.

3. One of the important factors of conflict using subjective rights is poor quality and content of the legal act inconsistency provisions of various acts of national legislation system together.
In Ukraine, acts which formulated human rights and at the same time laying the potential ineffectiveness of control mechanisms for their implementation, security and protection. Стаття присвячена дослідженню людиноцентризму в праві на сучасному етапі розвитку юридичної науки. Йдеться про взаємовідносини, взаємовпливи людини і права, визначення статусу права стосовно людини і людини – стосовно права. Досліджуються зміни і завдання юридичної науки. Вона намагається осмислити залежність права від людини. Існує особлива потреба вирізнити й зрозуміти думки, пов’язані з правом. Оскільки думка зайняла зараз найвищий ранг, то й право потрібно розглядати як напрям думки. Аналізується необхідність для людини образу її духовного життя на землі.

Статья посвящена исследованию человекоцентризма в праве на современном этапе развития юридической науки. Речь идет о взаимоотношениях, взаимовлиянии человека и права, определение статуса права по отношению к человеку и человека – относительно права. Исследуются изменения и задачи юридической науки. Она пытается осмыслить зависимость права от человека. Существует особая потребность выделить и понять мысли, связанные с правом. Поскольку мысль заняла сейчас самый высокий ранг, то и право следует рассматривать как направление мысли. Анализируется необходимость для человека образа его духовной жизни на земле.

Considering the right of a person (legal dimension of man), the author explores one of the subjects of legal anthropology - the impact of law on people. The concept of rights in law (human rights dimension) creates legal anthropology in which thought processes are carried out in the opposite direction: the set displays intellectual reality and spirit designed and reproduces only the set norms of positive law, since the rules of natural law does not create a person. Rights held by the person, are mostly alternate character. Current legislation forbids physical or method of self-defense claim in judicial and law enforcement authorities. Білак М. В. Формування Конституційним Судом України правових стандартів людиноцентричної спрямованості.
У статті досліджується питання запровадження принципу дружнього ставлення до міжнародного права в практиці конституційного судочинства, його людиноцентричну спрямованість. Розкривається природа вказаного принципу, його теоретико-практичне значення для практики здійснення захисту прав і свобод людини та громадянина судами України. У контексті нашої теми порушуються питання взаємодії практики Європейського суду з прав людини і Конституційного Суду України.

Ключові слова: людиноцентризм, принцип дружнього ставлення до міжнародного права, суд.

Билак М. В. Формирование Конституционным Судом Украины правовых стандартов человекоцентрической направленности.
В статье исследуется вопрос внедрения принципа дружественного отношения к международному праву в практике конституционного судопроизводства, его человекоцентрическую направленность. Раскрывается природа указаного принципа, его теоретико-практическое значение для пратики осуществления судами Украины защиты прав и свобод человека и гражданина. В контексте исследованной темы поднимаются вопросы взаимодействия практики Европейского суда по правам человека и Конституционного Суда Украины.

Bilak M. The Constitutional Court of Ukraine’s formation of person-centric legal standards.
The globalization of legal trends is driven by the search for additional guarantees to protect human and citizen rights and freedoms and to restrict the arbitrariness of state power. In this context, the application of international law plays an important role in Ukraine in developing common standards to guide judicial decisions, which too often take a positivist view of the application of law and fail to consider the fundamental nature of constitutional rights. Therefore, theoretical and practical solutions remain important to the search by Ukraine’s judiciary for person-centric legal principles through which matters affecting the protection of human rights in compliance with Ukraine’s international commitments can be resolved.
The Constitutional Court of Ukraine plays a special role in this process, since, applying various canons of interpretation, it rules on the scope of law and on the interpretation of person-centric constitutional principles. The European Convention for the Protection of Human Rights and Fundamental Freedoms and the case-law of the European Court of Human Rights are an important instrument and authority for the official interpretation of the provisions of the Constitution of Ukraine. The principles laid down in decisions of the European Court of Human Rights allow the Constitutional Court of Ukraine to pour content into person-centric constitutional provisions.
Accordingly, the Constitutional Court of Ukraine has introduced in its practice the “principle of a friendly approach to international law” as an aspect of constitutional interpretation, whereby international and European law form part of the official interpretation of relevant constitutional provisions, particularly with respect to constitutional rules relating to human rights. As a result of the application of the “principle of a friendly approach to international law”, a new determinative legal definition of constitutional rules on human rights is emerging. This definition can be considered as the criterion against which the constitutionality of positive law of the country is tested. In essence, a modern system of constitutional justice facilitates the emergence of a new paradigm regarding the legitimization of law – a paradigm whereby human rights pose the criteria of values by which positive law is judged as to its compliance with the principle of the rule of law, and by which these rights are protected by judicial practice.
