Ющик О. О. Правове і неправове нормативне регулювання у сфері спорту.
Стаття присвячена розгляду особливостей нормативного регулювання відносин у сфері спорту. Аналізуються література з проблематики спортивного права, позиція авторів, які вбачають специфіку цього регулювання у поділі нормативної регламентації спорту на два нормативних комплекси – правове і неправове нормативне регулювання, а також висловлюються різні позиції щодо взаємодії вказаних комплексів. Відзначається дискусійність вказаної позиції, пропонується авторський підхід до визначення природи нормативного регулювання у сфері спорту.

Yushchyk O. Legal and non-legal regulation in the field of sports.
The article is devoted to the consideration of the peculiarities of normative regulation of relations in the field of sports. It is stated that there are still controversial ideas about the nature of the norms governing the relations in the field of sports, which necessitates additional theoretical research. It is noted that the regulatory regulation of sport researchers are divided into «sports law» – a complex of regulatory regulations in the field of sports and «lex sportiva» – a complex of other (except for legal) regulatory regulation.
Characterized by the position of authors who consider sports as an independent right complex area of law, and examines the opinions of scientists regulatory system lex sportiva, the nature of which has not a clear understanding.
It is noted that the legal regulation in the field of sports is considered only legislative rationing of sports by the state, and normative regulation of acts that are not included in the system of state law, considered as non-legal regulation.
Characterized by the definition of «lex sportiva» through the description of its structure, the feature of which is that this association of complexes of out-of-law regulations in the field of sport crowns the international «superstructure», the independent subsystem complexes of which are the rules of the International Olympic Committee and a number of other international sports organizations.
It is emphasized that the norms of «lex sportiva» do not have binding legal force, but they have some normative force and are obligatory for the observance or implementation of the sports relations by the participants under the threat of offensive against them and the application of sanctions for them. A critique of the «lex sportiva» norm as non-legal is given.
From the analysis of the points of view of scientists regarding the division of regulatory regulation of the sphere of sports into two regulatory regulators in the article, it is concluded that in order to determine the nature of normative regulation of sport, it is necessary to find out the nature of relations within the framework of sport as a social institute and the rules corresponding to these relations.

Андрєєв А. В. Зміст та специфіка гарантій правового регулювання кадрового забезпечення Державної служби України.
У статті визначено класифікацію гарантій правового регулювання кадрового забезпечення Державної служби України. Розкрито зміст кожного з видів конституційних та спеціальних гарантій у досліджуваній сфері.

Andreev A. The content and specificity of the guarantees of legal regulation of personnel provision of the State Service of Ukraine.
In the article the classification of guarantees of legal regulation of personnel support of the State Service of Ukraine is defined. The content of each of the types of constitutional and special guarantees in the investigated sphere is disclosed.
Named following are the hallmarks of the group of constitutional guarantees of legal regulation of staffing of the State Service of Ukraine: 1) establishment by the state in the content of constitutional norms; 2) ensuring the right of citizens of Ukraine to obtain employment opportunities in the civil service and to protect this right in accordance with the procedure established by law; 3) the small and indirect relation to the legal regulation of personnel support of the State Service of Ukraine.
Signs of a group of special guarantees of legal regulation of personnel support of the State Service of Ukraine are as follows: 1) consolidation in the content of the provisions of the Law of Ukraine «On Civil Service»; 2) ensuring the objective nature of the process of occupying vacant posts; 3) the focus on the continuity of the process of raising the professional competence of civil servants; 4) ensuring the professional growth of civil servants; 5) granting candidates the opportunity to occupy a vacant post of civil service and pr otect their rights in court or extrajudicial order.
The following features of guarantees of legal regulation of personnel support of the State Service of Ukraine are distinguished:
1) mediated nature – the guarantees we have provided are established primarily for the purpose of involving citizens in the civil service, however, to a lesser extent, there are means to protect their rights in the process of fulfilling their official authority;
2) complex nature – the inextricable link between constitutional guarantees and guarantees established by the legislation on civil service;
3) protective nature – guaranteeing the ability of civil servants to protect their rights and interests in court or extrajudicial order;
4) objective character – establishment in order to guarantee objectivity in the process of employment of candidates for vacant positions;
5) continuous – the focus is on ensuring the continuity of the process of raising the level of professional competence and civil servants.
It is concluded that the issue of guarantees of personnel provision of the State Service of Ukraine is one of the fundamental in the field of civil service, but has not been investigated at all. The structure of guarantees for staffing is complex and consists of constitutional and special. The availability of such guarantees allows for the involvement of competent and professional persons in the civil service, as well as guarantees the possibility for civil servants to self-fulfillment.

Bahanets V. Concepts and features of the coordination role as a function of the state: the administrative legal aspect.
In the article the concept of coordinating role as a function of the state is described. The administrative-legal signs of this legal phenomenon are characterized.
The role and functions of the state as of today is a category that was the subject of the analysis of many scientific studies. They were studied by the scholars of the theoretical law sciences, the science of public administration, as well as specialists of administrative law. As our object was the subject of studies of various legal sciences, the views on its essence and components differ considerably, causing pluralism of scientific opinions on this subject. The same is the multidimensional view of the scholars for each specific role and function as a separate line of activity and the state’s influence on social relations.
The coordinating role of the state consists in the manifestation of such coordination in one or another legal relationship with the participation of state bodies acting as authorized representatives of the state. It was emphasized that the coordinating role of the state can be manifested both directly in the organization of activities of state-power subjects, and in public relations, which are not directly subordinate to the state, but are subject to coordination through the relevant state power subjects. In any case, the role and function s of the state are inextricably linked.
Coordination involves coordinating actions that involves choosing between different options for an optimal behavior pattern. Although in practice, the achievement of a positive result is not always guaranteed, but the process of coordination focuses on the desire to choose the best model of interaction and behavior within a given administrative or social system. That is why the guiding principle in defining the notion of the coordinating role of the state is the principle of going to ideal efficiency.
At the heart of the coordinating role of the state as its functions are the key features of this concept, among which we highlight the following: coordination is available in legal relationships between fully or partly legally equal entities; coordination always presupposes a full or partial level of discretion of actors whose actions are coordinated; coordination involves the interests of coordinated subjects and the reciprocal relationship between them; coordination aimed at achieving results. These features are the basis of the delineation of the coordination role as a function of the
state from other functions that are implemented with the help o f another tool.

Базов В. П. Конституційний судовий контроль у сфері захисту прав особи як елемент верховенства права.
У статті досліджуються поняття, організація та здійснення конституційного судового контролю у сфері захисту прав, свобод та інтересів особи в Україні. Доводиться, що конституційний судовий контроль є елементом верховенства права. Стверджується, що конституційний судовий контроль за діяльністю законодавчої та виконавчої влади є невід’ємним елементом конституційного ладу держави.
Дається визначення системи конституційного судового контролю в Україні. Зазначається, що національна система конституційного судового контролю включає в себе такі конституційно-правові інституції, як Конституційний Суд України, суди системи судоустрою України та відповідні міжнародні судові установи, юрисдикція яких визнана державою. При цьому вказується, що здійснення судового контролю міжнародними судовими установами є додатковим елементом національної системи конституційного судового контролю.

Bazov V. Constitutional judicial control in the field of the protection of individual rights as an element of the rule of law.
The article explores the issues of concept, organization and implementation of constitutional judicial control in the field of protection of rights, freedoms and interests of the individual in Ukraine. It also affirms that constitutional judicial control over the activities of legislative and executive powers is an integral part of the constitutional order of the state.
Defines the system of constitutional judicial control in Ukraine. It is stated that the national constitutional judicial control includes such constitutional and legal institutions as: the Constitutional Court of Ukraine, the courts of the Ukrainian judicial system and international courts whose jurisdiction is recognized by the state. While it indicates that the implementation of judicial control by international courts is an additional element of the national constitutional judicial control system.
The jurisdiction of the Constitutional Court of Ukraine, administrative and other courts of judicial system in the sphere of constitutional judicial control has been analyzed. Based on the analysis of the peculiarities of the legislative provision of the lawsuit in administrative matters in the field of control over legal acts, it is pointed out that there is no unity of legal regulation of certain procedural procedures during the consideration of such disputes.
Proposals on the improvement of the existing legislation in the sphere of constitutional judicial control.

Базов О. В. Міжнародно-правові аспекти тлумачення правових актів у правозастосовній судовій діяльності.
У період становлення України як правової та демократичної держави, в якій визнається і діє принцип верховенства права, актуалізується необхідність удосконалення міжнародно-правових механізмів організації та здійснення судової влади як на національному, так і міжнародному рівні.
Судове тлумачення займає особливе місце серед видів тлумачення, оскільки висновки суду щодо змісту правової норми, зокрема і норми міжнародного договору, є остаточними й обов’язковими для решти суб’єктів права. До того ж, даючи тлумачення нормі праві, суд ґрунтується на загальних засадах права, на основоположних правах людини.

Ключові слова: міжнародне право, міжнародне правосуддя, суд, юрисдикційні повноваження суду, судове тлумачення.

Bazov О. International legal aspects of the interpretation of legal acts in law enforcement judicial activity.
During the formation of Ukraine as a legal and democratic state in which the principle of the rule of law is recognized and operates, the need to improve international legal mechanisms for the organization and implementation of judicial power on both the national and international levels.
The judicial interpretation occupies a special place among the types of interpretations, since the conclusions of the court concerning the meaning of the legal norm, including the norms of the international treaty, are final and binding for all subjects of law. Giving an interpretation of the rule of law, the court is based on human rights.
The doctrine of the interpretation of international treaties and other normative legal acts as an integral part of the theory of law and the state, the theory of international law and creates an important branch of legal science. The development and improvement of the theoretical basis of the judicial interpretation of the norms of international treaties, laws and other national regulations occupies an important place in science of international law and is particularly relevant to modern Ukraine, which makes extensive use of international legal mechanisms, including international judicial, for protection of national interests at the international level. The need for clear regulations of the procedure of judicial interpretation requires the further development of the science of international law.
Taking into account the fact that Ukraine has its own system of interpretation of the Constitution, international treaties, laws and other legal acts, courts should exercise their interpretation within the framework of their competence and create legal positions in such a way that they meet the norms of international law, and also international and European standards of justice, the rule of law. Important at the same time is the consideration of the practice of interpretation of law by international courts.
The aim of the research is to create a concept of international legal support for the activities of international and national courts in interpreting the law. It is based on the doctrine of processional unity of judicial activity and universal bases for the modernization of the norms of international treaties and national legal acts in the field of justice and ensuring the unity of judicial practice.
Conclusions are drawn that the development of issues of judicial interpretation of the norms of international treaties and national legal acts is especially urgent for Ukraine in modern conditions. Proposes to interpret the norms both in the study of the problems of the theory of international law and in the theory of law in general. Substantiated the need to develop problems of legal interpretation of judicial activity, which is based on the requirements of constitutional and legal reforms (concerning justice). It was stated that the international legal aspects of judicial interpretation are of great importance in judicial activity and their further study and improvement is extremely necessary.
