Барбул П. О. Адміністративно-правове регулювання повноважень Міністерства оборони України у сфері управління Збройними Силами.
У статті висвітлюються повноваження Міністерства оборони України (далі – Міноборони) щодо управління Збройними Силами України (далі – ЗСУ), розглядаються окремі проблеми їх адміністративно-правового регулювання та вносяться пропозиції щодо його вдосконалення.
Зазначається, що Міноборони здійснює військово-політичне та адміністративне управління ЗСУ. Завдання щодо здійснення військово-політичного та адміністративного управління ЗСУ тісно пов’язані з іншими завданнями Міноборони.
Перелік повноважень Міноборони, що закріплені в Положенні про нього, виглядає хаотичним і недостатньо систематизованим. Удосконаленню реалізації повноважень Міноборони сприяли б їх уточнення та більш чітка систематизація в законах України «Про оборону України», «Про Збройні Сили України», Положенні про Міноборони відповідно до завдань, які поставлені перед міністерством. При цьому потрібно враховувати політичне призначення міністерства і зв’язок його завдання щодо управління ЗСУ з іншими завданнями міністерства.

Barbul Р. Administrative-legal regulation of the Ministry of Defense of Ukraine authorities in the management sphere of the Armed Forces.
The article covers the powers of the Ministry of Defense in relation to the Armed Forces of Ukraine management, discusses the separate problems of their administrative-legal regulation and makes proposals for its improvement.
Defense reform continues in Ukraine. Despite a number of steps already taken in the direction of reforming the Armed Forces command, the question of the Ministry of Defense political status remains relevant, as well as improving the administrative and legal regulation of its authorities in the management area of the Armed Forces. The issues outlined should be solved by improving the regulatory acts that define th e Ministry of Defense competences.
It is noted that the Ministry of Defense carries out military-political and administrative control of the Armed Forces. The Armed Forces of Ukraine military-political leadership is an activity aimed at ensuring the implementation of the state policy in the Armed Forces, political and strategic goals in the defense field, principles and directions of the Armed Forces development. The Armed Forces administrative leadership is an activity aimed at the comprehensive provision of the Armed Forces viability, their functioning and development within the fulfillment framework the main state defense policy tasks.
The Ministry of Defense in the sphere of the Armed Forces of Ukraine management implements the policy of the state in the Armed Forces, ensures their functioning, combat capability, conducts intelligence and informational analyses activities in order to ensure the fulfillment of tasks entrusted to the Armed Forces, controls law compliance in the Armed Forces, and performs other powers provided by law. The implementing the military-political and administrative management Armed Forces tasks are closely linked with other the Ministry of Defense tasks.
Analysis of the Ministry of Defense authority allows us to state that the powers enshrined in the current version of the Ministry of Defense Regulations, in general, reflect the political purpose of the Ministry of Defense. However, the authorities list seems chaotic and not systematic. The Ministry of Defense Statute contains a list of 119 non-exhaustive acts carried out by the ministry. At the same time, a few smaller actions can be covered by a broader action, some of these actions are quite similar in content or even the same.
The implementation improvement of the Ministry of Defense authorities would contribute to their specification and clearer systematization in the laws of Ukraine «Defense of Ukraine Act», «Armed Forces of Ukraine Act», the Ministry of Defense Regulations in accordance with the tasks set before the Ministry. At the same time, it is necessary to take into account the political purpose of the Ministry and the connection of its task with regard to the Armed Forces management with other tasks of the ministry.

У статті проаналізовано специфіку правового регулювання соціального забезпечення публічної служби в Польщі. На основі позитивного досвіду цієї країни запропоновано напрями розвитку для України.

Bernatskaya N. Polish experience in the legal regulation of social security of the public service.
In the article the specifics of the legal regulation of the social security of the public service in Poland are analyzed.
Based on the positive experience of Poland in the field of study proposed directions of borrowing in Ukraine.
The public service is an institution whose standards of operation are essentially borrowed from foreign countries, since the current civil service institute, which has been obtained along with another regulatory legacy of the Soviet Union, should be considered more widely today to achieve greater efficiency and effectiveness. Therefore, the public service as an institution that is in the process of formation requires an analysis of the experience of such states, in which the history of its functioning is richer, and social provision of public servants, as its important substitute institution, is no exception in this context.
The Prime Minister of Poland has special powers to increase wages or establish additional benefits for certain categories of public servants. However, we find that regulation of the sphere of social security of public servants by subordinate legal acts in the domestic realities is unacceptable.
A judge in Poland goes to retirement at the age of 65 (both men and women), in which case, if the judge does not wish to retire after reaching the age of 65, he has the right to hold a post of judge until he reaches the age of 70 years provided submitting a request to the Minister of Justice for his desire to continue to hold office with the provision of a certificate that he/she can, on the state of health, perform the duties of a judge. In this context, we consider to be positive:
1) equalizing the retirement age of women and men of judges;
2) providing judges with the opportunity to perform official activities and after the retirement age if health permits.
It is noted that in Ukraine the problem of providing judges with housing is one of the most acute in the context of social security of public service, therefore the appointment of judges at the place of residence:
1) make it easier for the judge to solve domestic issues related to appointment;
2) reduce the financial burden on the state budget;
3) will be a logical continuation of the state’s policy aimed at reducing the amount of social security for public servants.
Summarized that the domestic law on public service is similar to Polish, so effective borrowing of certain experience is rather problematic. It should be noted that, unlike in Ukraine, the Polish public service is characterized by a much wider range of measures, both material and social. However, taking into account the current trends in the development of legal regulation of the social security of the public service under national law, the adoption of such experience is not relevant.

Бойко О. В. Конституційні принципи та міжнародні стандарти забезпечення наукової діяльності: проблеми рецепції в Україні у контексті зарубіжного досвіду.

Стаття присвячена дослідженню головних засад наукової діяльності в національній та міжнародній площинах відповідно до політичного й соціального контексту їхньої реалізації. У результаті проведеного дослідження робляться висновки та формулюються рекомендації, які було б доцільно врахувати під час формулювання стандартів та принципів наукової діяльності в Україні.

Boiko O. Constitutional principles and international standards of scientific activity: problems of reception in Ukraine in the context of foreign experience.
Including in the scientific community of the EU provide a significant amount of the benefits. It requires the implementation of a set of high standards of quality of scientific activity, to achieve which Ukraine is currently directing all its intellectual efforts. There is another not so clear conclusion: if our state reaches its goal, it can become a «point of non-return». Because the close relationship of the scientific community in the EU forms practically «the only organism », for the sake of the efficiency of work requires coherence .
Therefore, before integrating into the EU scientific community, Ukraine needs to study in detail the standards and principles of organizational and legal construction of scientific activities in order to ensure its organic inclusion and benefit from such cooperation.
One of the topical problems of reforming Ukrainian science lies in the axiological plane. The scientific community of the EU is building its reform policy, considering the principles of science improvement as a way for organizational transformations that will contribute to the achievement of specific high-quality results. In Ukraine, however, they remain for a long time in declarations in view of the desperate efforts of some representatives of the government and the scientific community to maintain the status quo of the current organizational structure, which blocks the path to meaningful shifts.
It has been established that the principles and standards of scientific activity are very closely related to the policy in the relevant field, and therefore the scientific community should make maximum efforts and involve all mechanisms of civil society in order to preserve the sustainability of those that will direct the national science to a truly high-quality level, which don`t depending on the change of political orientations.
The guideline for the development of domestic principles and standards of scientific activity should be international principles, which according to the direction of their influence can be divided into the requirements of the virtue of the representatives of science and the quality of the scientific process, which may include including the educational process.

Ващенко А. М. Перспективи наукового дослідження правотворчої діяльності органів і посадових осіб держави та місцевого самоврядування як складова сучасної правової аналітики.

У статті розкрито актуальність наукового пізнання теоретико-правових аспектів перспектив наукового дослідження правотворчої діяльності органів і посадових осіб держави та місцевого самоврядування як складова сучасної правової аналітики. Узагальнено наукові погляди вчених, які стосуються аналізу перспектив наукового дослідження правотворчої діяльності органів і посадових осіб держави та місцевого самоврядування. Встановлено науково-дослідний потенціал теоретико-правових аспектів правотворчої діяльності органів і посадових осіб держави та місцевого самоврядування. Виокремлено й обґрунтовано положення, які визначають напрями наукового вивчення правотворчої діяльності органів і посадових осіб держави та місцевого самоврядування.

Vashchenko A. Prospects of scientific research of law-making activity of bodies and officials of the state and local self-government as an integral part of modern legal analytics.
The work reveals the relevance of scientific knowledge of the theoretical and legal aspects of the prospects of scientific research of law-making activity of bodies and officials of the state and local self-government as an integral part of modern legal analytics. The scientific views of scientists concerning the prospects of scientific research of lawmaking activity of bodies and officials of the state and local self-government are generalized. The research potential of the theoretical and legal aspects of law-making activity of bodies and officials of the state and local self-government is established. The provisions determining the directions of scientific study of law-making activity of bodies and officials of the state and local self-government are grounded and substantiated. Prospects of scientific development of issues of law-making activity of bodies and officials of the state and local self-government are: 1) strengthening the scientific research of historical-methodological and legal aspects of the correlation of law-making activity of bodies and officials of the state and local self-government; 2) intensification of the scientific study of the phenomenological aspects of law-making activity as the sphere of functioning of bodies and officials of the state and local self-government; 3) it is important to analyze and generalize the scientific opinions of scientists concerning the theoretical, legal and practical aspects of the legislative powers of bodies and officials of the state and local self-government, as well as issues of their interrelations; 4) to analyze the scientific approaches to understanding the procedural aspects of law-making activity;
5) requires a thorough analysis of scientific approaches to understanding the concept of «act of law-making», their synthesis and identification of the benefits of the approach that will be taken as the basis for further research; 6) acquire a high level of relevance of research into the problems and prospects of the development of law-making activity of bodies and officials of the state and local self-government in Ukraine in terms of its coordination, coordination in order to prevent conflicts of authority, conflicts and gaps in the provisions of law-making acts, etc.
